The man Cain Velasquez was imprisoned for attempting to murder, Harry Goularte, as well as his family, are facing a civil lawsuit over accusations of molestation and negligence.

MMA Junkie reports that a civial lawsuit has been filed against Goularte, his business, Certified Custom Concrete, his mother, Patricia Goularte, as well as her business, Patty’s Childcare, and his stepfather, Paul Bender.
They face a number of allegations, including alleged sexual assault of a minor. The plaintiffs listed on the document are anonymous, however, the initials match the initials of Velazquez’s four-year-old son. Velasquez’s criminal defense attorney, Mark Geragos, has also identified Velasquez’s son as the alleged victim in the case.
The 13-page document accuses of not providing proper supervision and care to the alleged victim. Goularte, specifically, is accused of removing the child’s clothes, touching their privates, and exposing himself to the child on “numerous” occasions from 2021 to 2o22.
As for Patricia Goularte, Bender, and the Patty’s Childcare staff, they are alleged to have “allowed this behavior and conduct to occur and continue to occur and failed to adequately monitor and supervise [the victim] and Harry.”
“Despite the warnings, observations, and signs of inappropriate behavior and conduct, Harry, at all times, remained permitted to reside on the property of Patty’s Childcare.”
The complaint also argues those involved in the home daycare did not take proper steps to deal with sexual assault that was known about.
Also, the complaint mentions past citations the daycare received form the State of California, not in any sexual relation, totaling 10 since 2018.
There were also several inspection reports that referenced Harry Goularte and Paul Bender specifically by name as having passed necessary criminal background checks as well as received child abuse index clearances or exemptions as recently as January 2022.
Listed as representing the plaintiff in the case, attorney Warren Paboojian, had the following to say.
“The defendant should be prosecuted to the full extent of the law,” Paboojian wrote. “His terrible criminal acts of abusing (my) client should (receive) the harshest criminal punishment available by law. The daycare facility should never operate again. And the owner should be held accountable both civilly and criminally for her neglect. This daycare has a history of neglect when it comes to following state laws pertaining to child safety and care.”
The plaintiffs are seeking economic damages, non-economic damages, costs and attorneys’ fees, punitive damages against Harry Goularte only, pre-judgment/pre-trial interest, and any other/further relief the court deems appropriate, per the complaint.
43-year-old Goularte is out on bail after pleading not guilty during a June 6 hearing in Morgan Hill, California. He faces a felony charge of lewd acts with a minor child and is due to return in court on September 20. He faces charges that carries a sentence of up to eight years in prison and/or a $10,000 fine.
Former UFC heavyweight champion Cain Velasquez is currently behind bars for attempted murder, as he rode Goularte down on the street, armed with a firearm. He recently had a second request for bail denied and remains locked up in Santa Clara County Main Jail North.
